Terms and Conditions for Using the Khalsah Platform / Application
Overview
These regulations and terms constitute a formal agreement ("contract") between the Khalsah platform / application and the customers registered on the Khalsah platform or its application. The platform is defined as an electronic website that enables customers to request various services such as land freight, air freight, sea freight, customs clearance, warehouses and storage facilities, laboratories, and standards services from logistics service providers across all the different fields.
In these terms and conditions for users ("Terms of Use"), words such as "we," "us," "our," or "Khalsah" refer to this website, its branches, staff, employees, agents, and affiliated companies.
Terms of the Khalsah Platform / Application
By accepting the use of this website, you agree to be bound by the Terms of Use of the website and the Privacy Policy (collectively referred to as the "Terms"), as well as all laws and regulations, and you agree that you are responsible for compliance with any local laws.
If you do not agree to any of these Terms, you have no choice but to immediately cease using this website. We confirm that the materials contained on this website are protected by applicable copyright and trademark law. You may not use this website, and you may not accept these Terms, if you are legally prohibited or barred from receiving or using this website under the laws of the country in which you reside or through which you may access or use the website.
Definitions:
The Platform: means https://khlasha.com/ .
Usage Agreement: refers to the agreement and terms of use of (the Khalsah website and application).
The Customer: refers to anyone who uses the Platform for the purpose of requesting a service.
Ownership: refers to Salasil Al-Imdad wa Al-Tawreed for Business Services Company, which is the owner of the Platform and the Application.
The Service: refers to every request submitted within the Platform or the Application.
The Third Party: refers to the logistics service providers.
Limitation of Liability:
We at Khalsah are not a company specialized in the field of customs clearance, land freight, sea freight, air freight, warehouses and storage, or laboratories and standards. Rather, we provide these services through which we help specialized companies to carry out marketing and offer their services to customers digitally and to enable their business with logistics service providers ("the Third Party"), alongside other content that we have hosted and developed. Customers and the Third Party are responsible for preparing the request and details and sending inquiries between themselves directly, and we do not take part in any communications between customers or the Third Party, nor do we participate in any part of the deal after the request is accepted. We retain the details in good faith, but these details are produced directly by customers or the Third Party and we do not verify them. You are responsible for submitting your own inquiries, and we make no warranty and accept no responsibility for the accuracy or completeness of any of the information contained in the details. You are responsible for verifying and confirming the details and being satisfied as to their correctness. Under no circumstances shall we be liable for any damages (including, without limitation, compensation for loss of data or profits, or business interruption) arising from the use of, or the inability to use, the materials on the website, even if one of our authorized representatives has been notified orally or in writing of the possibility of such damage.
Requesting Service Directly with the Third Party:
The services available through Khalsah include information about the Third Party. In the event that a deal is made outside the Khalsah platform / application with the Third Party, we are not responsible for examining or evaluating the service, and we do not guarantee and will not bear any responsibility that may arise between you and the Third Party, or for any other materials, products, or services provided by the Third Party. Therefore, please review the policies and practices of the Third Party carefully and make sure you understand them before entering into any transaction. Complaints, claims, concerns, or questions relating to the Third Party's products must be directed to the Third Party directly.
Comments / Customer Reviews:
If you write a comment at our request regarding the quality of the service provided to you, or without a request from us, you will be sending creative ideas, suggestions, or proposals in order to improve and develop the service and give a good impression to other customers. You agree that we are permitted, without restriction, to edit, copy, publish, distribute, translate, and use these comments that you send to us in any medium whatsoever. We are not obligated to keep these comments confidential, to respond to these comments, or to pay any compensation for these comments. We are permitted, but not obligated, to monitor, modify, or remove content that we determine at our discretion, including but not limited to a comment that is unlawful, offensive, threatening, defamatory, pornographic, obscene, or objectionable, or that violates the intellectual property of any party or these Terms of Service. You also acknowledge and agree that your comment will not violate any right of any third party in any form. You also agree that your comments will not contain any defamatory, unlawful, offensive, or obscene material, or contain a computer virus or other harmful software that affects in any way the operation of the Platform or the Application. You are also not permitted to use an incorrect email address, or to pretend to be someone else, in order to mislead us or the Third Party. You alone are responsible for any comments you make, and we accept no responsibility for any comments posted by you or the Third Party.
Personal Information:
We do not trade, sell, or leak customers' personal identity data or contact data to other parties. However, we do share general information that is not linked to any personal identity information of customers, for the purposes of development and improving customer service, or sending messages, or communication. We also send it to the Third Party service provider for the purpose of facilitating the business of the customers, the Platform, or the Application in managing activities, including but not limited to sending data or communicating with customers, or as required by business interests. Customer data shared with the Third Party is limited to the scope of the business within the Platform or the Application only.
Payment and Fees:
Placing the Order and Prices
Fees vary according to the customer's choice of the requested service, and the price is determined based on the customer's preference: first, whether preferring price or a random selection. The customer must also verify the accuracy of the information entered before making the purchase decision. We would like to note that we at Khalsah strive to provide a distinguished service to our customers, and we accept no responsibility for any consequences resulting from the customer's choice of any of the products or services for comparison.
Receiving Payments
Payments are accepted through the payment methods approved and available at Khalsah, and the available and accepted payment methods are determined in the Company's policy. The customer bears full responsibility for paying the amounts due and government fees, including but not limited to taxes and government fees applicable in customs clearance services. The applicable fees and taxes are determined in accordance with the applicable local and international laws and legislation.
The customer must pay the amounts due to the Third Party immediately upon completion of the service and upon receipt of the requested services or products, and is not permitted to delay payment. Khalsah bears responsibility for ensuring the safety of payments and protecting customers' financial information, and the necessary security methods are used to achieve this. The Company bears responsibility for carrying out financial transfers in a fast and secure manner, and for determining the duration of the transfer and the fees applicable to it in accordance with the Third Party's invoices.
Non-Receipt of Goods
The available delivery period is determined in accordance with the details stated in the Company's policy, and the Third Party must provide clear information to customers regarding delivery expectations. In the event that the customer does not wish to receive the goods that have been purchased, they must notify the service provider of this as soon as possible in order to reschedule another time for delivery, and the Company must provide the necessary support to determine the reason for non-receipt and provide appropriate solutions. In general, if the customer wishes not to receive the goods or to change the delivery date, cancellation or postponement fees for the order may apply, and additional fees may be charged on the amount paid in accordance with the policy of the relevant store or company.
Order Cancellation
The customer has the right to cancel the order before the Third Party heads to the pickup location.
Prohibited Activities:
The Khalsah platform / application allows you to obtain all of its services, provided that the scope of your use of them is for personal or commercial purposes, and you acknowledge and undertake to avoid the following prohibited activities, including but not limited to:
Smuggling of goods, funds, or prohibited property.
The unlawful transport of hazardous materials, weapons and ammunition, illegal products, narcotics and psychotropic substances, and living organisms and endangered animals.
The unlawful storage of hazardous materials, the storage of flammable materials, the storage of explosive hazardous chemical materials, dealing with radioactive materials without a license, the storage of rotten or spoiled food materials, or the storage of materials that infringe intellectual property rights.
Forging documents or using incorrect documents, forging customs documents, or evading the payment of customs fees and taxes imposed on goods.
Fraud, deception, or cheating in shipping and delivery operations.Using hazardous or environmentally harmful materials in an irresponsible or unlawful manner.
Carrying out any activities that infringe intellectual property rights, trademarks, or copyrights.
Failing to disclose necessary information to the relevant authorities.
Carrying out any unlawful or unethical activity.
Causing harm to property or persons.
Forging documents or using incorrect documents.
Failing to comply with local and international laws and regulations.
